ACCEPTANCE AND DESCRIPTION OF SERVICES

Webs-a-gogo’s websites and services are subject to the following terms and conditions (Terms/Conditions). Webs-a-gogo reserves the right to update or alter these Terms/Conditions without notice at any time. This website will always contain the most current version of the Terms/Conditions. A violation of any of the Terms/Conditions below may result in action by Webs-a-gogo , up to and including the termination of your account and access to your site/services, with or without warning. Unless explicitly stated otherwise, any new features that enhance or replace current Services shall be subject to the Terms/Conditions.

"Webs-a-gogo.com" is the public name for a private service offered by Webs-a-gogo. This service provides websites, web tools and web hosting. Webs-a-gogo offers various, related web services, including site building, content editing, and promotion tools (Services). These Services are accessed through the World Wide Web. Payment of all service and equipment fees associated with WWW access is your responsibility.
  1. REGISTRATION: Information provided by you as part of the registration process is subject to our Privacy Policy. You agree that the information you provide about yourself during the registration process (Registration Data) will be true, complete, current and accurate. You agree to maintain the currency of your Registration Data by updating it when changes occur. You agree that Webs-a-gogo may use and rely on Registration Data provided or updated by you for any purpose concerning your account, to include billing matters.
  2. FEES AND PAYMENT: In consideration of the Services you purchase, you agree to pay Webs-a-gogo the established fee for said Services as advertised on this website at the time of purchase or, subsequently, upon invoice by Webs-a-gogo. You also agree that renewal prices may be higher or lower than your original pricing. All fees are due immediately and, unless expressly noted elsewhere in this agreement, are non-refundable.
  3. CANCELLATION AND TERMINATION: Webs-a-gogo reserves the right to cancel any Member’s Services for any reason. Webs-a-gogo provides web hosting to sites that abide by our Terms/Conditions. If you or Webs-a-gogo cancel your Services, the cancellation will immediately stop all Services. Webs-a-gogo sites may only be hosted at Webs-a-gogo. If you cancel your membership, your site cannot be transferred to another hosting provider. You will no longer have access to your website and all associated information may be deleted by Webs-a-gogo.
  4. SECURITY: It is your responsiblity to maintain the security of your account and any other Services. You are completely responsible for any activity conducted under your account and for any actions taken in connection with your website. You agree to notify Webs-a-gogo in writing of any unauthorized uses of your account or of any breaches of security. Webs-a-gogo will not be liable for any loss or damage arising from your failure to maintain the security with this security obligation. You acknowledge and agree that under no circumstances will Webs-a-gogo be liable, in any way, for any acts or omissions by a Member or Guest, including any damages of any kind incurred as a result of such acts or omissions.
  5. CONTENT, CONDUCT RULES AND OBLIGATIONS: You and any person who has access to your account must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. You are entirely liable for all activities conducted through your account. Webs-a-gogo reserves the right to remove Content which in Webs-a-gogo's sole discretion is deemed harmful, offensive, or otherwise in violation of the Terms/Conditions or any rules or policies Webs-a-gogo has in place at the time.

    You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, goods, products, services or other materials ("Content") are the sole responsibility of the Member or visitor who distributed such Content. You, and not Webs-a-gogo, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Services. Webs-a-gogo does not control the Content posted via the Services and, as such, does not guarantee the accuracy, integrity or quality of such Content. In no way and under no circumstances will Webs-a-gogo be liable for any Content. You are responsible for all risks associated with use of any Content. By your use and viewing of Content, you understand that Webs-a-gogo does not review Content but that Webs-a-gogo has complete rights to remove, alter, replace, or reproduce all Content.

    Webs-a-gogo is not responsible for the Content of any Member including home pages, forums, blogs, discussion groups, media and comments. We reserve the right to remove any Content that is in violation of our Terms/Conditions. Members will be held legally responsible for the Contents of their web pages, including but not limited to use of copyrighted material without the permission of the author or posting material considered indecent for minors. The use of Services for illegal purposes is strictly forbidden and any account found to be or believed to be, in the sole discretion of Webs-a-gogo, violating the law may be removed without notice.

    You are not to upload any Content, media, program, software or music files to our server absent full ownership or other legal right to said Content. Copyrighted files not belonging to Members or Guests posting those files may be deleted without notice. You agree that you will not originate any Content that may be described by any of the following descriptions:

    >> Material containing viruses or any other malicious code, file or program designed to intentionally harm or limit the functionality of computing software, hardware or telecommunications equipment
    >> Pirated software or media
    >> "Cracked" Copyrighted software
    >> Offers for or solicitation of ANY sexual services

    >> Hacking, "phishing", or "phreaking" related material  

    >> Serial numbers which can be used to illegally validate or register software  

    >> Making available tools which can be used for no purpose other than "cracking" software
    >> Material which promotes hate, bigotry, defamation, threats, harrassment ,intolerance, or illegal activities
    >>"Adult", pornographic, obscene, nude, graphically violent, and other inappropriate Content
    >> Usernames, file names, directory names, tags, descriptions, or titles which are offensive and indecent
    >> Links to any of the above

    You agree that you will not use the Services to engage in any of the following activities:

    >> "Spamming" to promote your website or Content, or engaging in unethical marketing, advertising, or any other practice connected in any way to "spam". Further, that all of your emails which are not considered to be SPAM as defined in our SPAM policy, which are sent to your clients for the purposes of promotion or advertisement, will be CAN-SPAM compliant.     >> Harming minors in any way.
    >> Impersonating any person or entity, including, but not limited to, a Webs-a-gogo official, forum leader, guide or host, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
    >> Stalking, threatening, defaming, or otherwise harassing another
    >> Forging titles or otherwise manipulating identifiers to disguise the origin of any Content used with Services
    >> Upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party
    >> Promoting pyramid or Ponzi schemes or any scam or scheme intended to generate money
    >> Offering for sale or sell any item, good or service that violates any applicable federal, state, or local law or regulation; you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations; or that Webs-a-gogo determines, in its sole discretion, is inappropriate for sale Webs-a-gogo Services
    >> Soliciting personal information, passwords, or other data for commercial, unlawful, unethical, or dishonest purposes
    >> Attempting to interfere with, disrupt, or break into Services, networks, servers, equipment, or Content related to the Services
    >> Violating in any way any applicable local, state, national or international law, including, but not limited to, regulations pertaining to the U.S. Securities and Exchange Commission and public or private exchanges
    >> Making any automated use of the Services  
  6. DISCLAIMER OF WARRANTIES: Webs-a-gogo's Service is provided AS IS with no warranty. As fully as permitted by law, Webs-a-gogo disclaims all warranties, express or implied. This disclaimer includes, but is not limited to, Implied Warranties of Merchantability and Fitness for a Particular Purpose, Title and Non-Infringement. You acknowledge that reliance on any information or content on the Service is done at your own risk.

     
  7. MONEY-BACK GUARANTEE

    Webs-a-gogo provides both free and paid services to users. Paid for services and products which originate at Webs-a-gogo include a 7-day money-back guarantee.
    If you are not satisfied with your service for any reason, you are elligible to receive a refund for services or products purchased provided that you cancel your paid for services within 7 days of the purchase date.      **see below for exclusions or exceptions

    To cancel your service and receive a refund, simply contact your web specialist or our support staff at Webs-a-gogo via telephone, post marked us mail, date-time stamped email, or via our support contact form and request to cancel the service in question. Once we receive your request, Webs-a-gogo will consider your request as of the date sent and gladly and promptly process your request. Please read our exceptions policy below.

    ** EXCEPTIONS TO MONEY BACK GUARANTEE: 
              Domain Names: When you purchase a Domain Name from Webs-a-gogo, Webs-a-gogo has to pay Internic for your Domain Name upfront on your behalf. Domain Names purchased from Internic through Network Solutions are Non-Refundable. As such we cannot recover money for names purchased then no longer wanted. Once you buy a domain, that's it, you own it. As such our money-back guarantee does NOT apply to Domain Name Registration, Transfer, Renewal or other Domain Name Specific Services. Once you purchase your domain name or purchase a service which is an attribute of or for your domain name, it is final. Domain Names are owned by the buyer and a Domain Name cannot be "returned" until the duration of the domain registration term has expired. All domain name purchases are final at the time of purchase. If you purchase a WAG-PAC or other packaged offer with a domain name bundled in it, then the current advertised price of our domain names will be withheld from your refund. Our standard price for Domain Names is $15.00/yr. 
              SSL Certificates: When you purchase an SSL Certificate for your website, Webs-a-gogo must pay our provider for the certificate up-front. As with Domain Names , we cannot get our money back, so we cannot refund the money you spent for your SSL Certificate either. Currently there is no way to recover you money spent on SSL certificates. All SSL sales are final. Our standard price for one RapidSSL Certificate is $39.00/yr and $120.00/yr for our Website Wildcard SSL Certificate.
              RELIEF FROM DOMAIN NAME EXCEPTION:  Although we cannot offer relief from SSL expenses, Webs-a-gogo can make an effort to help you recover the cost of your Domain Name after cancellation of you account. After you cancel we can offer you a free subscription to our Domain-To-Go After Market Domain Sales Program. With this subscription you can post your Domain Name for sale here at Webs-a-gogo. Just login to the Domain To Go Site here at Webs-a-gogo using your Member credentials and follow the wizard to enter your domain name into the sales pool. If and when your domain name sells, Webs-a-gogo will pay to you the final sale price of the domain name less a $1.50 processing fee within three business days after the payment from the buyer clears.


     
  8. INDEMNITY:   By using Services under these Terms/Conditions, you agree, at your own expense, to indemnify, defend and hold harmless Webs-a-gogo and its affiliates, officers, directors, employees, consultants, agents, suppliers, licensors, co-branders, and other partners from and against any and all third-party claims, liability, damages, losses and/or costs (including but not limited to reasonable attorneys’ fees) arising from or relating to: (a) your failure to comply with these terms of use; (b) your infringement or violation of any intellectual property or other right of a third party; (c) your violation of any applicable law; and (d) your Content, use of Services, Guest activity, connection to Services, or your violation of any other rights of any other party; regardless of whether you are registered as a Member. Webs-a-gogo will not be liable for any of its services. We have the right to cancel our service at any time, and we will not be liable for any files that are lost and/or corrupted which may occur (including, for example, from a system crash, security breach, or hard disk failure). To the full extent permissible under the applicable law, Webs-a-gogo shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use Webs-a-gogo services.  
  9. RESALE: You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of Webs-a-gogo. 
  10. RECIPROCAL LINKING:  In keeping with our standard SEO link policy, Webs-a-gogo places a small trade banner at the bottom of each Webs-a-gogo Module website we license. In return, Webs-a-gogo offers a similar banner back to theach and every website we sell. This promotes our clients sites from Webs-a-gogo and visa-versa. When search engine bots crawl websites and find two sites linking to each other it promotes their index ranking higher than that of a one-way link. In as much as Webs-a-gogo offers pre-made templated websites for use under license to our customers at discount prices, we are always looking for new and better ways to promote our name, and yours. Rememeber, your success is our success. If at any time you wish to have the Webs-a-gogo trade banner removed from view at the bottom of your site, just ask and we'll make it so.
  11. PROPERTY: All templates offered by Webs-a-gogo are copyrighted material. Such templates are offered for use to Webs-a-gogo users under license only, and are not offered for sale or unbridled use. Such license limits use of Webs-a-gogo templates to sites hosted by Webs-a-gogo through its Services. Webs-a-gogo templates may not be transferred to or hosted on another web host or Internet Service Provider.
  12. GENERAL: These terms of use shall be governed by and construed in accordance with the laws of the State of Georgia. Both parties submit to the personal jurisdiction in Georgia. These Terms/Conditions of Use constitute the entire agreement between you and Webs-a-gogo with respect to the Service. You acknowledge and agree that you have read and understand the provisions of these terms of use. By using this site, you consent to the terms of use described herein, including any updates. Webs-a-gogo reserves the right to vary these terms of use from time to time and will update the "Effective Date" section above when such changes are made.
